1. Architectural Aesthetics for new construction:

  1. Window glass shall be recessed a minimum of 3" from the finished surface of the adjacent wall or 2"x4" pop-outs except under patios/cover.

  2. Front detailing must be continuous on all elevations.  Pop-outs, banding, vigas, caps, etc.

  3. Paint colors:

1. Muted earth tones

2. LRV value between 35 and 70.  Maximum LRV value may be lower than 70 in some plats.

  1. Roof tile colors:

1. Muted earth tones

  1. All flat roof colors must not exceed the LRV applicable in that plat.

  2. Fences will match the house color except where they extend over 75 feet from the residence.  In that case the color must be approved by the NCOA.

2. Fitting the Neighborhood:

  1. The architectural character of all buildings shall be such that they are in harmony with a compatible to the architectural character adopted by the Committee of Architecture for the zone in which a subject lot is situated, and they shall be in harmony with and compatible to existing structures erected within a given zone.

XI. General Land Use Regulations and Guidelines

  1. Side distances

Fences and walls may be erected or planted in rear or side yards to a height not exceeding six feet, provided they shall not be closer that 15 feet to a public right-of-way line.

Structures over six (6) feet in height should not be within seven (7) feet from the neighbors property line.

No fence, wall, hedges, trees, plants, shrubs, or foliage shall be planted, kept, or maintained in such a manner as, in the opinion of the Committee of Architecture, shall create a serious potential hazard or a non-aesthetically pleasing appearance to the other residents of the area.

  1. Garages and Carports

On rural 190, RU-43, R1-35, R1-18, R1-10, R1-8 and R-2 zoned areas there shall be provided on the same building site at least one garage or carport for each dwelling unit not less than ten feet in width and having a minimum area of 200 square feet, together with a paved driveway connecting the same with a street and permitting ingress and egress of an automobile.

  1. Model Homes

Model Homes may be maintained by permit issued by the Committee of Architecture.  The permit will be issued for no more than 12 months.  A model home may be used only as such, and may not be used as a residence or for the conduct of any business other than the display or sales of  similar homes offered by the owner, builder or developer in the subdivision.  The conduct of a general real estate business from a model home shall be presumed if the user does not maintain a separate place of business within the Town  of Fountain Hills.
