In the event that the Arbitration Board's award is in favor of the Committee of Architecture, all or a portion of the funds shall be paid to the Association to cover the costs of arbitration proceedings.

The question to be submitted to the arbiters shall be:

"On (date) the Neighborhood Committee of Architecture decided that the (state the decision being appealed.) Was the decision of the Committee unreasonable?

In considering the question, the arbiters shall take into consideration the intent, purpose and provisions of the Declaration of Reservations, and the rules, regulations and guidelines of the Committee.  In addition to answering the arbitrated question, the arbiters may make recommendations.  Such recommendations, however, shall not be binding upon the Committee or the appellant.

The question shall be presented to the arbiters in substantially the form attached in appendix E.

IX. Permits Required

  1. No structure of any kind shall be erected, have its exterior altered (including, but not limited to, its color or materials), be added to, be placed or be permitted to remain upon any property in member plats without a permit from the Committee.
  2. Applications for permits must contain, where appropriate, two copies of the floor areas, external design, landscaping, parking and drive areas, ground location and structural details as requested on appropriate NPOA forms.  All changes to approved plans must be approved before any construction begins on the affected area.  For requirements of a complete application package refer to the "Printable Forms" page of this web site. 
  3. When applying for a construction permit, or any other permit that may be required prior to altering the appearance of the property, a fee may be charged to cover the cost of processing the application.  These fees are shown in the "Schedule of Fee's" page of this web site.  The fee shown in this schedule must be submitted with the proper application in order to be considered for approval.
  4. Failure to apply and pay permit/compliance fee and failure to pay for permit extensions are considered violations and subject to a daily fine effective with the second request to apply/pay such fees.
  5. Permits associated with a violation will only be valid for 6 months from date of approval, with no extensions available.

X. General Architectural Guidelines

All structures must be of an architectural character in harmony with and compatible to existing structures in the subdivision generally, and in the neighborhood in which the structure is to be constructed, specifically.

NOTE: Plats 601B, 604C, 604D, 511 and Stoneridge South have additional restrictions.  If you are building or remodeling on these plats, please contact the office vie e-mail or phone.

In addition to the provisions of the Declaration of Reservations, the following architectural guidelines are adopted by the Committee of Architecture in reviewing and/or approving plans for proposed buildings in member plats.  However, such buildings will be judged on their individual merit.

    1. Design Character

The design character will be compatible with the Southwestern Desert.  Materials, windows, fascias, and wide roof overhangs which create strong shadow patterns and architectural features are encouraged.
