V. NPOA Committee of Architecture

The Committee is appointed by the NPOA Board of Directors.  It is the purpose and duty of the Committee to interpret and enforce aspects of the Declaration of Reservations, with the specific goals and purposes of the Declaration and its drafters in mind.  The Committee will enforce and maintain a general land use plan for the maintenance, development and improvement of the member Plats to maintain a high standard of architecture so as to enhance the aesthetic values of the community.  A quorum shall consist of three or more members.

The Committee shall act in accordance with these regulations and guidelines.  The Committee:

  1. Shall receive all applications required by the Declaration and these rules, regulations and guidelines;
  2. may examine premises for which applications have been made;
  3. may make inspections to ensure compliance with the provisions of the Declaration and these rules, regulations and guidelines;
  4. shall issue such notices or orders as may be necessary to enforce compliance with the provisions of the Declaration and these rules, regulations and guidelines;
  5. shall keep careful and comprehensive records and make regular reports of its activities and actions to the Board of Directors;
  6. shall approve or disapprove of plans, permits, variations and exceptions in accordance with the Declaration, these rules, regulations and guidelines, and Committee policy.

The Committee may authorize its Chairman to make and/or issue certain routine administrative approvals.  All such decisions or approvals shall be subject to ratification or appeal to the Committee as a whole.

The Board of Directors of the Association shall have the authority to revise these guidelines from time to time in order to comply with the wishes and desires of the members of the Association.

In the event the Declaration of Reservations, as implements by these rules, regulations and guidelines conflicts with any town, county or state law or regulation, the most restrictive shall govern.

VI. Exceptions and Variances

  1. Authority for granting Variances

The Committee of Architecture has limited authority to grant exceptions to the Declaration of Reservations, when the following factors exist:

  1. Good planning would require the exception;

  2. The exception would not be detrimental to the public welfare;

  3. The exception would not detract from the property of any person located in the vicinity.
