1. Clotheslines
    No exterior clotheslines shall be installed on any lot.  Clothes drying on balconies or in public view is also prohibited.
  1. Parking
    All lots or parcels must provide adequate parking facilities to accommodate the intended use of the subject lot or parcel.
  1. House Colors
  1. The color of all dwellings or other buildings shall be muted desert tones. (Revised 07/14/09) The Light Reflective Value (LRV) of any paint shall not be below 20 and shall not exceed 70.  White, illuminative, or reflective type colors are prohibited.
  2. When a house is to be repainted, a permit application must be filed with the Committee.
  3. Paint samples with the associated LRV must be attached to the submitted application.
  1. Roof Colors
    The color of roofs on all dwellings or other buildings shall only be muted tones or earth colors.  White, illuminative, or reflective type colors are strictly prohibited if the roof is visible from any vantage point.
  1. Temporary Buildings
    No temporary building, including tents, shacks, shanties, tin sheds, or other structures shall be erected or placed upon a lot.  No temporary buildings, basements, cellars, tents or other similar structures shall at any time be used for human habitation.  Notwithstanding the foregoing, a trailer may be used as a residence of the owner and his family or by a contractor during construction, but only after a permit for such use has been issued by the Committee of Architecture, and then only after the Committee shall have approved plans and specifications for the erection of the said permanent residence.  In no event shall such temporary facility be allowed to exist on any lot for longer than 180 days.
  1. Unnatural Drainage
    Under no circumstances shall the owner of any lot or parcel of land deliberately alter the topographic condition of his lot or parcel in any way that would permit or cause additional quantities of water from any source other than what nature originally intended, to flow from his property onto any adjoining property or public right-of-way.  The routing of pipes from roof drainage systems shall not cause additional quantities of water to flow onto any adjoining property or public right-of-way.
  1. Use of Premises
    A person shall not use any premises which is designed, arranged or intended to be occupied or used for any purpose other than expressly permitted in the Declaration of Reservations, or rules and regulations and guidelines of the Committee of Architecture.
     
  2. Open Air Structures
    Open air structures will be reviewed on an individual basis taking into consideration its location on property, materials and usage.  Aesthetics are considered.   3. Mailboxes                                                                                                                                                                                                              Structures encompassing a standard Post Office approved mailbox shall match the design, material and color of the residence.  All mailboxes must be maintained.  (3/1/07)
  4. Livestock, Poultry, and Pets                                                                                                                                                                                               Animals, livestock , or poultry of any kind shall not be raised, bred, or kept on any lot in any zone, except that dogs, cats, or other household pets may be kept provided they are not kept, bred, or maintained for any commercial purpose and are on the owner's property, and not kept in quantities which create an annoyance or nuisance to the neighborhood.  Dogs are only permitted off resident's property when leashed and curbed.  Horses are permitted in Rural 190 and R1-35 zones not adjacent to commercial zones and only upon issuance of a permit from the Committee of Architecture.  Owners of horses shall, (a) take sufficient measures to control flies and to provide for temporary storage and disposal of manure, (b) comply with Maricopa County, Town of Fountain Hills and Arizona rules and regulations, (c) erect a corral containing a minimum area of one thousand two hundred (1,200) square feet for each horse and any additional control fencing that may be appropriate or required by the Committee of Architecture, (d) erect appropriate storage for tack and feed equipment, and (e) erect shading for each horse as approved by the Committee of Architecture.
    All corral boundaries shall be at least forty (40) feet from the nearest lot line and not closer than eighty (80) feet from any dwelling. (08/26/10)
