Fountain Hills Declaration of Reservations
IND-1 ZONE: RESEARCH AND DEVELOPMENT
The following regulations are intended to provide a planned industrial district which will not depreciate the character of the Fountain Hills residential community. They are aimed at permitting certain forms of research and development businesses to function in an area with adequate space and free from offense in modern, landscaped buildings. The end result of these regulations is to create a harmonious relationship between business and residential living.
The following regulations shall apply in the IND-1 zone unless otherwise provided in this Declaration of Reservations:
Uses Permitted
A building or premises shall be used for only the following purposes:
Laboratories, research, experimental and testing.
Manufacture of electrical or electronic apparatus, musical instruments, ganes and toys.
Offices.
Radio and television broadcasting stations and studios, but not including transmitter towers and stations.
The Committee of Architecture may permit any other office, laboratory, research and development uses similar to those uses enumerated herein which do not create any danger to the public health, safety, and general welfare in surrounding areas, and which do not create any offensive noise, vibration, smoke, dust, odor, heat, or glare, and which, by reason of high value in relation to size and weight of merchandise received and shipped, create very little truck traffic.
Height Regulations
The maximum height of buildings shall not exceed forty (40) feet or three
stories.
Yard regulations
Yards are not required except as follows:
Front Yard
There shall be a front yard having a depth of not less than fifty (50) feet.
For through lots a front yard shall be provided along both front lot lines.
For corner lots having the rear lot line in common with the side lot line of a key lot, or where the separation of such lot lines is an alley, the yard along each street side of such corner lot shall conform with the front yard regulations.
Side Yard
There shall be a side yard on each side of a building having a width of not
less than twenty five (25) feet, except on the side of a lot adjacent to a
rural or residential zoning district, in which case there shall be a side
yard having a width of not less than fifty (50) feet.
Rear Yard
There shall be a rear yard having a depth of not less than fifty (50) feet.
Intensity of Use Regulations
The intensity of use regulations are as follows:
Lot Area
Any lot shall have a minimum lot area of thirty five thousand (35,000)
square feet.
Lot Width
Any lot used for dwelling purposes shall have a minimum width of one hundred
fifty (150) feet.
Lot Coverage
The maximum lot coverage shall be thirty (30%) per cent of the lot area.
Paving Regulations
The paving regulations are as provided in the General Land Use Regulations
for all zones set forth within this Declaration of Reservations.
Loading and Unloading Regulations
Loading and Unloading for Commercial Buildings
For all commercial buildings there shall be provided one (1) loading and
unloading space for each twenty-five thousand (25,000) square feet of floor
area, or fraction thereof, devoted to such use in the building.
Location of Required Loading and Unloading Spaces
The required loading and unloading spaces shall, in all cases, be on the
same lot as the use they are intended to serve. In no case shall
required loading and unloading spaces be part of the area used to
satisfy the parking requirements. They shall not be located on the
street side of a parcel or lot, not on the side of a lot or parcel generally
used by the public.
Additional Regulations
The additional regulations are as follows:
All uses except for parking, loading, and unloading shall be conducted within a completely enclosed building.
Any lighting shall be placed so as to reflect the light away from adjoining rural or residential zoning districts.
Required yards adjacent to any streets shall not be occupied by any use or structures except for drives and roadways, signs, and lighting as permitted in this ordinance.
Subdivision of Lots
No lot or parcel of land shall be divided into smaller lots or parcels
whether for lease, sale, or rental purposes, provided that variations may be
granted by the Committee of Architecture in accordance with provisions of
this Declaration of Reservations and in compliance with any local, county,
or state regulations.
